*ATTENTION ALL CUSTOMERS. BAHRNS.com been experiencing issues while updating our website. Certain product we offer are sold by carton or case quantity. Some of these items are having issues with the carton / case quantities registering and computing accordingly. ACCEPTANCE OF ORDERS:

CONTRARY TERMS; ACCEPTANCE OF BUYER'S ORDER IS CONDITIONED UPON BUYER'S ASSENT TO THE FOLLOWING TERMS AND CONDITIONS, AND ANY INCONSISTENT PROVISIONS OF ANY PURCHASE ORDER OR OTHER WRITING SHALL NOT CONSTITUTE A PART OF THE CONTRACT OF SALE. If any of these terms and conditions are not acceptable to Buyer, Bahrns Equipment Inc. must be notified promptly. PRICING & SPECIFICATIONS: All prices in the Bahrns Equipment Inc. catalog reflect Buyer's net cost in U.S. currency. The prices do not include freight, applicable federal, state, and local taxes, charges and duties, or special crating requirements for export shipment. Buyer shall pay all such costs, taxes, charges, and duties. Prices, colors, and specifications are subject to change without notice. We reserve the right to adjust and communicate pricing should an error be found in published material.

PAYMENT TERMS:
Open account terms of net of no less than 10 days after shipment (Net 10) are extended to firms listed and satisfactorily rated by Dun and Bradstreet. Unrated or unlisted firms are requested to submit three (3) major trade references and the name of their local bank. Buyer may expedite an order, while Bahrns Equipment Inc. establishes open account status, by including payment with the order. NOTE: Bahrns Equipment Inc. also accepts Master Card, VISA, American Express, and Paypal. Orders made by firms applying for credit will not be processed until Bahrns Equipment Inc. has completed its credit review.

Should your firm be accepted for an open account Bahrns Equipment Inc. reserves the right to require half-down or paid in full for first purchase via credit card, wire transfer or check. In the case of wire transfer or check, the order will not be processed until payment is received. All initial account purchases must be PAID IN FULL by way of credit card, check or wiring. Initial order will be processed once money is received.

EXCLUSIVE WARRANTY:

All products are warranted (1) by the manufacturer to the extent of the manufacturer's express warranties to Bahrns Equipment Inc. or (2) to be free from defects in materials and workmanship under normal use and service. This warranty is exclusive and is in lieu of any other warranty, express or implied, including, but not limited to, any implied warranty of merchantability or fitness for a particular purpose.

BUYER'S EXCLUSIVE REMEDIES:
Bahrns Equipment's. liability and Buyer's exclusive remedies under Bahrns Equipment Inc. warranty shall be limited solely to repair, replacement, credit or refund, at Bahrns Equipment's option, with respect to products returned to Bahrns Equipment Inc. pursuant to Bahrns Equipment's instructions. Bahrns Equipment Inc. shall not be liable, under any circumstances, for consequential or incidental damages, including, but not limited to, labor costs or loss of profits arising in connection with the use of or inability to use products purchased from Bahrns Equipment Inc..

SHIPPING:
All items designated as IN STOCK ship FOB from one of our warehouses. Factory Quick Ship items ship promptly (usually within 1 week) from our manufacturer's stock, FOB point(s) as indicated. All other items are FOB the point(s) of origin indicated in the catalog. Unless otherwise requested by Buyer, goods will be shipped via carriers of our choice with shipping, handling, insurance, and packaging charges prepaid and added to the invoice. Any extra charges for services requested by Buyer, i.e., special routing, inside delivery, or pre-delivery notification must be paid by Buyer. Expedited deivery is available upon request.
 
DAMAGED SHIPMENTS; RISK OF LOSS:
Buyer should thoroughly inspect all items for shipping damage before accepting delivery. If damage has occurred, Buyer should note the extent of the damage on the freight bill and call Bahrns Equipment Inc. immediately. Although Bahrns Equipment's responsibility for loss and damage ceases when the products are accepted for shipment by the carrier, Bahrns Equipment Inc. will, when notified, file a damage claim for goods shipped via a carrier of our choice, issue credit for the damaged goods and ship an immediate replacement. Buyer shall, at Bahrns Equipment's option, return any damaged products to Bahrns Equipment Inc. pursuant to Bahrns Equipment's instructions.

RETURN POLICY & PROCEDURE:
Since 1966, our growth and reputation have been based on customer trust and satisfaction. If for any reason you are dissatisfied with a product you receive from Bahrns Equipment Inc., merely call us for shipping instructions and return it for full credit minus restocking fees. There are no returns accepted for custom and made-to-order products unless proof of damage in shipment. Buyer must contact Bahrns Equipment's Sales and Service Department for confirmation and shipping instructions prior to returning any products. All returns must be shipped prepaid, in resalable condition, and are subject to inspection for damage or misuse prior to issuance of a credit or refund. Products must be returned to the warehouse within 45 days of receipt.

RETURN POLICY & PROCEDURE:

You may return all items sold by Bahrns.com  (Bahrns Equipment Inc.) within 30 days of receipt. We will credit you your total purchase price less a 25% restocking fee and the amount Bahrns Equipment incurred for shipping the product(s) to you. Your return package must be post-marked within 30 days of the date you received your items.

Shipping charges are not deducted if a store credit is requested.
 
Bahrns.com does not cover your return shipping costs. However, if the return is a result of an error we made in your order or a product defect, we will of course also refund all shipping costs, including your return shipping costs, and offer you a refund or a store credit if that is your preference. Refunds will be issued upon receipt and inspection of the returned products.

We cannot issue any refunds or exchanges for the return of certain items, including:
Any item that has a return post-mark dated after the 30 day return period,
 any item that is not in its original condition or is damaged, any custom made products.

If you would like to return any item(s) you must contact us to request a RMA# (Returned Merchandise Authorization Number). Please email us at support@bahrns.com or call us at 1-800-432-29091-800-432-2909 between 8:00 am-5:00 pm Monday through (Central Standard Time).  If you are contacting us by email, please list the product codes and quantities of the items you are returning.

CONTROLLING LAW:
The validity, construction and enforcement of the purchase agreement between Bahrns Equipment Inc. and Buyer shall be governed by and interpreted under the laws of the State of Illinois. In the event of any dispute arising out of this agreement, you consent to the personal jurisdiction of the federal and/or state courts located in the County of Effingham, State of Illinois, United States of America.

SALES TAX:
Sales Tax required for IL. Add sales tax on the total merchandise plus shipping and related charges.

TERMS OF USE STATEMENT

You understand and agree that the owners of this site shall not be liable for any direct, indirect, incidental, consequential or exemplary damages, including but not limited to, damages for loss of profits, data or other intangible losses (even if the owners of this site have been advised of the possibility of such damages), resulting from the use or the inability to use the product(s) and or service(s) or any misuse of the product(s) and or service(s) in a manner not in accordance with their intended use.
